All copyrights to anything within this zip file is retained by the original creator of the file: LBCreations - Designs by Babette. All graphic images and/or designs are copyrighted by LBCreations - Designs by Babette with all rights reserved. By downloading and accepting receipt of this or any other product (whether purchased or received as a free sampler) by LBCreations - Designs by Babette, you accept the conditions included in this TOU.

COMMERCIAL USE

Please note: Purchasing a commercially licensed digital scrapbooking product entitles the purchaser use of these designs as a design resource to be used to help create their own designs with the intent of selling said creations - products may not be resold "as is." Purchaser MAY NOT use my commercial use products to create commercial use. The results and/or products of your derivative work created with my products must be sold to the end user with a personal use and/or S4H license only. The purchaser may use the RESULTS of their design process that comes from using these products , but are not allowed to resell the actual LBCreations - Designs by Babette products elsewhere.

You MAY use these items to create items to sell (kits, packs, etc) with the following exceptions:

1. You MAY NOT use these graphics to create any sort of designer resource, tool or commercial use product or repackage and resell my original products. Further, you MAY NOT create brushes, rub-ons, clip-art, templates, overlays, tubes, shapes, doodles, actions, styles etc. from my original work. You MAY NOT convert images to grey scale and sell as a template. In addition, YOU MAY NOT Make Digitalized Embroidery designs, make Rubber Stamps, make Cross stitch kits (digital or printed), make texture maps to resell or redistribute in any way. YOU MAY NOT add them to Software Programs.

2. You MAY NOT claim these as your own creations, or alter them and claim them as your own.

3. You MAY NOT make kits or sets containing only items created using my items - a maximum of 25% is allowed.

4. You MAY NOT use my products to create Stock Images and sell/distribute in any form.

5. You MAY NOT use my products to create products any print source such as paper or fabric lines. If this is your intent, please contact me to discuss a special license agreement.

6. You MAY NOT use my designs/graphics to create or design websites, blog-headers, make site templates, etc. If this is your intent, please contact me to discuss a special license agreement.

7. You MAY NOT offer them in a cd/dvd, graphic collections, trade, share, loan, rent, resell, distribute, or post across a bulletin board, network, modem, yahoo groups, website links, Internet or web page.

8. You MAY NOT use these graphics for any obscene, defamatory, or immoral works ... or any other purpose which is prohibited by law.

Freebies and/or Samplers:

Purchaser may use purchased products in the creation of freebies for the purpose of promoting their own work. However, this is limited to 25% of the total freebie and must be a derivative work - you may not use my products "as is."

Credit in your TOU is very much appreciated, however not mandatory.

SCRAP 4 HIRE:

You may use my graphics in scrapbooks for others for pay (Scrap4Hire). By this I mean: you are commissioned by a person to make a scrapbook for them and it can be done either digitally, on CD, printed or hard cover.

You MAY NOT make “plopper” pages or quick pages (pre-made pages) and sell or distribute them in any way to the general public. You MAY create Quick Pages and Digital Photo Albums for your customers provided that they only receive the final, flattened version of the product (i.e. no psd files, no individual papers/elements files, etc) saved as either .pgn or .jpg formats.

You may make paper greeting cards, candy wrappers, posters, altered books/paint cans, stationery, labels, and many other crafts for sale in PRINTED form of these graphics as long the amount does not exceed 100 units. If this is your intent, please contact me to discuss a special license agreement.

You MAY NOT create these items and sell them digitally. These graphics are designed at 300 ppi so they are print quality. If this is your intent, please contact me to discuss a special license agreement.

You MAY NOT use these graphics to make mass produced items (over 100) and sell them on the internet. If this is your intent, please contact me to discuss a special license agreement.

You MAY NOT use my designs/graphics to create or design websites, blog-headers, etc. If this is your intent, please contact me to discuss a special license agreement.

In addition to the above:

PERSONAL USE:

When you agree to download products you accept to use them for YOUR (the buyer's) personal use only. It is strictly forbidden to resell or redistribute the products (paid for or free) to a third party, in any possible form. You may use my graphics in your own LOs and you may send LOs to magazines & post to online .

1. You MAY post to online galleries, personal blogs, Facebook (social sites) without need to credit, however it's always appreciated.

2. You MAY feel free to alter these images to fit your personal scrapbooking.

However, If you use these graphics in a layout submitted to any magazine, or any other publication - You MUST give credit to LBCreations - Designs by Babette AND my store URL: http://digiscrapprodesigns.com.

Remember, any modified and/or altered files are also protected by copyright law and may not be shared and/or used for commercial gain with the express written permission of the designer, LBCreations - Designs by Babette.

In addition:

LBCreations - Designs by Babette is not responsible for the use of this (or any other) product including, but not limited to, the clip art, textures, brushes, styles, templates, digital art images, etc. by any person, organization or business in any documents, periodicals, web pages, or other electronic or print media. Due to the nature of the products (digitally downloaded) offered by LBCreations - Designs by Babette, no exchange or refund is possible. Although refunds & exchanges will not be provided, LBCreations - Designs by Babette will go to great extremes to be sure you receive your digitally downloaded product, including providing it to you via alternative means of download if necessary. Refunds will NOT be provided for any reason (including inability to unzip the file, don't like the product after purchase, thought it was for paper scrapping, etc.). LBCreations - Designs by Babette will do our very best to help rectify the issue you may be having with your digitally downloaded product.
